Warranties

Product Conformity: The Seller guarantees that its products will adhere to and perform substantially in accordance with the specifications referenced in the capacity tables.

Non-Infringement Warranty: The Seller warrants that the products do not infringe upon any copyright, patent, or trademark.

Warranty Disclaimer, Limitation of Liability

The warranties stated in the above section are exclusive and replace all other warranties, whether expressed or implied, including any implied warranties of merchantability or fitness for a particular purpose. The Seller shall not be held liable for any special, incidental, or consequential damages, even if informed of the possibility beforehand. This exclusion of liability for special, incidental, or consequential damages applies to all causes of action, including, but not limited to, breach of contract, breach of warranty, negligence, strict liability, misrepresentation, and any other cause of action based on similar or dissimilar legal theories.

Technical Assistance

Unless expressly stated otherwise by the Seller:

1. (a) Any technical advice provided by the Seller regarding the use of goods provided to the Buyer shall be provided without charge;
2. (b) The Seller assumes no obligation or liability for any such advice or for any results arising from the application of such advice; and
3. (c) The Buyer shall bear sole responsibility for selecting and specifying the goods appropriate for their intended use.

Patents

The Seller shall not be liable for any costs or damages incurred by the Buyer based in whole or in part on claims:

1. (a) That the use of any products, or any part thereof, provided hereunder in combination with products not supplied by the Seller; or
2. (b) That a manufacturing or other process utilizing any product, or any part thereof provided hereunder, constitutes either direct or contributory infringement of any patent of the United States.

The Buyer shall indemnify and hold the Seller harmless against any expenses or losses resulting from the infringement of patents, copyrights, trademarks, or other proprietary rights of a third party arising from the Seller's compliance with the Buyer's designs, specifications, or instructions.
